The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the website will be available at all times, error-free, or free from viruses or other harmful components. We make no representations about the accuracy, completeness, or reliability of any information on the site.

8. Limitation of liability

To the fullest extent permitted by applicable law, AclipA and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under applicable EU or Estonian law.

10. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia and applicable European Union law, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Estonia. If you are a consumer resident in another EU member state, you retain the right to bring proceedings in your country of residence under mandatory local consumer protection laws.
